Casie User Agreement

This Casie User Agreement ("Agreement") is a legal agreement between the user ("User") and Casie ("Provider") regarding the use of the Casie software application ("Application"). By accessing or using the Application, the User agrees to be bound by the terms and conditions of this Agreement.

1. Definitions

a. “User” refers to any person directly or indirectly using Casie by participating in a Slack Channel to which Casie has been invited.

b. “Casie Administrator” refers to a “User” with Administrative privileges to manage the Casie account, application connections, and billing.

2. Everyday Business Activities:

   a. The User acknowledges that the Application is intended for use in everyday business activities. The User agrees to use the Application in compliance with all applicable laws and regulations.

b. The User is 18+ years old.

c. The Casie Administrator acknowledges they (1) have the authority to implement Casie in connection to their work applications and colleagues (2) are responsible for communicating the Casie Application and this User Agreement to Casie Users in their Company Applications (3) Casie is not responsible for any violation of the User’s Company policies.

d. The User agrees to Casie’s Terms of Use and Privacy Policy.

3. Payment Terms:

   a. Billing: The User agrees to pay for the subscription to the Application on a monthly basis. The billing cycle will start on the anniversary day of signup. The subscription fee will be billed in advance for each month of use.

   b. Prorated Charges: If additional users are added during a billing cycle, the subscription fee for the remaining days of that month will be prorated. From the next billing cycle onwards, the full monthly charge will apply.

   c. Termination for Non-Payment: Casie reserves the right to terminate the User's access to the Application in the event of non-payment.

4. Termination:

   a. Casie reserves the right to terminate the User's access to the Application for any reason, including but not limited to misuse, abuse, or non-payment. Upon termination, the User will no longer have access to the Application.

b. The Casie Admistrator may terminate Casie services at any time by emailing support@casie.ai with a termination request. Termination requests will be handled within 5 business days without refund.

5. Refunds:

   No refunds will be provided for any charges incurred.

6. Intellectual Property:

   The Application and its content, including but not limited to text, graphics, logos, images, and software, are the property of Casie and are protected by intellectual property laws. The User may not modify, reproduce, distribute, or create derivative works based on the Application without prior written consent from Casie.

7. Limitation of Liability:

   In no event shall Casie be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the use of the Application.

8. Governing Law:

   This Agreement shall be governed by and construed in accordance with the laws of the State of Delaware. Any legal action or proceeding arising out of or related to this Agreement shall be brought exclusively in the courts of Delaware.

9. Data Policy

a. Removal of Connections and Account Closure:

   Casie acknowledges that users may request the removal of connections to applications and the closure of their Casie account. To initiate this process, users should send a request to support@casie.ai. Casie will make reasonable efforts to remove the connections and close the account within 5 business days of receiving the request.

b. Retention of Customer Data:

   Casie may retain customer data for a period of up to 6 months from the date of account closure or termination. This retention period allows Casie to comply with legal obligations, resolve disputes, and enforce agreements. During this period, the customer data will be securely stored and will not be accessible or used for any purpose other than those mentioned.

c. Deletion of Customer Data:

   If the Casie Account Administrator requests the deletion of customer data, Casie will make reasonable efforts to delete the data within 5 business days of receiving the request. Once the data is deleted, it cannot be recovered, and Casie will no longer have access to it.

d. Data Security:

   Casie takes reasonable measures to protect customer data from unauthorized access, use, or disclosure. To learn more about these measures, please visit casie.ai/security. However, it’s important to acknowledge that no method of transmission over the internet or electronic storage can provide absolute security.

e. Compliance with Laws and Regulations:

   Casie will comply with all applicable data protection laws and regulations regarding the collection, use, and storage of customer data.

10. Customer Support

If you pay us a Subscription Fee for Casie, you can select from support options available in-app, at no additional cost or email support@casie.ai. 

11. Entire Agreement:

   This Agreement constitutes the entire agreement between the User and Casie regarding the use of the Application and supersedes any prior or contemporaneous agreements, understandings, or representations.

By using the Application, the User acknowledges that they have read, understood, and agree to be bound by this Agreement.
